The previous provisions, which dated back to 2011, stated that not communicating the identity of the person driving the sanctioned vehicle was justified in case they arrived appeals in respect of reports that provided for the deduction of points on the license.

However, some recent jurisprudential orientations have shed light on some problems encountered by the police forces: the time needed to comply with the previous indications would risk going outside the deadlines set for the notification of the offense. Hence the decision to make the change.

For this reason, now, if we take fines we are obliged to immediately communicate all data relating to the person’s license who, at the time of the infringement, was driving the sanctioned vehicle.

So what will happen now? Even if any appeals are active, we must always disclose the information on the license if there is a deduction of points for the infringement committedfor example when you exceed the maximum limit for a speed camera too much.

The police will take care of communicate to the DMV the outcome of any appeal, whether for or against the sanctioned person. What will happen if this data is omitted?

The police, having acknowledged the circular of the Ministry of the Interior, then let it be known that in the case of the fines received the immediate communication of the data of the driver’s license is required, failure to comply with this obligation will result in an additional quantifiable fine of up to 300 euros.
